What is 40-Year Recertification?
The 40-year building recertification program is a mandatory safety inspection requirement in Miami-Dade and Broward Counties, designed to ensure older buildings remain structurally sound and safe for occupancy.
Following the tragic Champlain Towers South collapse in Surfside (June 2021), both counties have significantly strengthened their recertification requirements and enforcement. Florida Senate Bill 4-D (SB-4D) now mandates statewide milestone inspections for condo and co-op buildings, which integrate with local recertification programs.
Property owners receive a “Notice of Required Recertification” from their local building department when their building becomes due. Failure to comply can result in fines, violations, and potential condemnation proceedings.
Who Must Comply?
- All buildings 40 years or older
- Condominiums and cooperative associations (3+ stories)
- Commercial and mixed-use buildings
- Multi-family residential buildings
- Hotels and hospitality buildings
Exempt Buildings:
Single-family homes, duplexes, and buildings under 2,000 sq. ft. with occupant load of 10 or less are typically exempt.
County-Specific Requirements
Miami-Dade and Broward have similar but distinct recertification programs. We handle compliance for both counties.
Miami-Dade County
- Buildings 40 years or older require recertification
- Recertification every 10 years thereafter
- 90 days to submit report from notice date
- Structural AND electrical inspections required
- Florida-registered PE or Architect must certify
- Coastal buildings (within 3 miles): 25-year initial inspection for condos
Broward County
- Buildings 40 years or older require inspection
- Re-inspection every 10 years thereafter
- 90 days to return inspection report
- 180 days to complete required repairs
- Licensed PE or Registered Architect required
- Both structural and electrical systems evaluated
